Is Kratom Legal in Louisiana in 2020?

Is Kratom Legal in Louisiana?

Kratom is legal in Louisiana. Moreover, there is pending legislation to regulate kratom statewide. Previously, there have been several intents to ban kratom, but none of them succeeded. 

The state of Louisiana has tried to ban kratom on several occasions.

In 2014, the authorities received a bill that suggested adding to the controlled substance list any material, mixture or compound that contained kratom alkaloids Mitragynine, 7-Hydroxymitragynine, and/ or Mitragynine pseudoindoxyl. The bill eventually died in committee.

Yet, in 2015, the Louisiana Senate received the same bill. This time it passed, but legislators amended it and excluded kratom compounds from it.

In the first half of 2018, the kratom salmonella outbreak affected 3 people in the state of Louisiana. Luckily, none of the people involved in the outbreak died.

However, in May 2018, there was another bill. It urged the Louisiana Department of Health to study kratom and decide whether or not it should be included in the controlled substances act. A second bill to study kratom passed in May 2019.

The main concerns were that kratom is an unregulated substance and that it is easily available in gas stations and similar locations.

For now, there is no data on the progression of this study.

Efforts to Ban Kratom in 2019

A new bill to ban kratom in Louisiana was introduced in May 2019. Luckily, it did not succeed. Instead, since August 2019, the authorities are reviewing a new bill. Its aim is to regulate kratom.

Potential Regulation of Kratom in Louisiana

On February 28, 2020, a bill intending to regulate kratom in Louisiana was introduced. If this bill is successful, the Louisiana Kratom Consumer Act will regulate the manufacture, sales, distribution, and labeling of kratom products.
