Is Kratom Legal in Maine?

Kratom is legal in Maine. A bill in 2017 intended to ban mitragynine, one of the primary kratom alkaloids. However, the Maine Senate amended the bill to leave it out. An intent to regulate kratom in Maine also did not succeed. 

There are no federal laws regarding kratom in the United States. Therefore, individual states decide on the faith of kratom. Some states, such as Alabama and Vermont, have decided to ban kratom. Maine, however, is not one of them.

In April 2017, a bill that aimed to include a number of substances in the Schedule W list of controlled substances was introduced. Schedule W includes substances such as opium, morphine, heroin, methadone, amphetamine, and their derivatives, among many others.

Mitragynine was one of the substances that the sponsors of the bill proposed to include in Schedule W.

This brought a lot of concern to the kratom community in Maine. Many stated that certain locations in Maine had a large-scale heroin problem.

The Botanical Education Alliance urged kratom supporters and advocates to donate funds for activism to keep kratom legal. They were meant for lobbying and contacting the responsible authorities and voicing their opinions and experiences with kratom.

Because of this activism, the state legislators amended the language and left mitragynine out before passing the bill in June of the same year.

In 2019, Maine was considering the Kratom Consumer Protection Act, but the bill died.

As a result, kratom remains legal in Maine, yet it’s unregulated.

What Is the Kratom Consumer Protection Act?

The Kratom Consumer Protection Act is legislation that intends to regulate kratom leaf products. Developed by the American Kratom Association, it’s lobbied to individual states.

While states can decide on the content of their KCPA, it usually contains the following:

• Prohibiting kratom sales ot minors,
• Labeling kratom products,
• Disclosing the ingredients and alkaloid content in kratom products,
• Not selling kratom products with over 2% of 7-hydroxymitragynine of the total alkaloid content,
• Punishing kratom merchants who disregard the law.

As a result of this legislation, Maine natives and visitors would gain more transparency in kratom sales. The law would demand the purity of kratom products and punish those who do not comply.
